Terms & Conditions

Please read these terms of sale carefully before placing your order and retain a copy of these terms and your order for future reference

1. Format of the Contract

1.1 These terms of sale apply to all goods supplied by Nationwide Vehicle Contracts (UK) Ltd., whose registered office is at Unit 9, Christie Way, Christie Fields, Manchester M21 7QY registered in England and Wales No. 4408958 (the "Supplier").

1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order.

1.3 An acceptance of your offer to buy the goods will be sent shortly after your order. However, we do have the right to terminate the contract in the event that the goods are unavailable, mis-priced or cleared funds are not received.

1.4 The contract is subject to your right of cancellation (see below).

1.5 The Supplier may change these terms of sale without notice to you in relation to future sales.

2. Description and price of the goods

2.1 The description and price of the goods you order will be as shown on the Suppliers website at the time you place your order. Every effort is made to describe and show representative images of products and colours.

2.2 The goods are subject to availability. If after acceptance or job order the Supplier discovers within [14 days] of our acceptance of your order that the goods are unavailable we may terminate the contract and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.3 Every effort is made to ensure that prices shown on the Suppliers website are accurate at the time you place your order. If an error is found within 14 days of accepting your order, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If the Supplier does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel the order, or if the order is cancelled automatically due to the expiry of the 14 day period, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.

2.4 In addition to the price, you may be required to pay a delivery charge for the goods.

2.5 For products that require professional installation, prices quoted may be subject to change if any additional parts or labour are required. If we are carrying out work within the London Congestion Zone, this charge will be added to your order. We will only charge you once, even if we are carrying out multiple jobs within the Charging Zone.

3. Payment

3.1 Payment for the goods and delivery charges can be made by any method shown on the Suppliers website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.

3.2 There will be no delivery until cleared funds are received.

3.3 Payments shall be made by you without any deduction whatsoever unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you.

4. Delivery

4.1 The goods you order will be delivered to the address you give when you place your order, except that some deliveries are not made outside the United Kingdom.

4.3 If delivery cannot be made to your address for reasons under the Suppliers control the Supplier will inform you as soon as possible.

4.4 If you deliberately fail to take delivery of the goods (otherwise than by reason of circumstances under control of the Supplier) then without prejudice to any other right or remedy available to the Supplier, the Supplier may:

  • 4.4.1 store the goods until actual delivery and charge you for reasonable costs (including insurance) of storage; or
  • 4.4.2 sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods.

4.5 If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations the Supplier shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods. On exercising your right to cancel you shall be required to return the goods to the Supplier. Should you fail to return the goods, the Supplier reserves the right to deduct any direct costs incurred by the Supplier in retrieving the goods as a result of such failure.

4.6 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible.

4.7 Upon receipt of your order you will be asked to sign for the goods received in good condition. If the package does not appear to be in good condition then please refuse the delivery. If you are unable to check the contents of your delivery at the point of delivery then please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.

5. Fitting & Installation

5.1 Dependant on the product, the Supplier and/or installation engineer will arrange for your parts to be distributed from our warehouse or from an external supplier by a reputable courier. A signature will be required to ensure that the equipment has been delivered successfully. Please check that the parts match the parts on the order and they correspond to your vehicle. Without these parts, it will not be possible to carry out the work. Therefore we respectfully request that you or a nominated representative inform Nationwide Vehicle Contracts at least 24 hours prior to the appointment if the parts have not arrived or are incorrect.

5.2 The vehicle, parts and mobile phone must be accessible and present at the agreed time of the install. Our engineers will wait for a maximum of 20 minutes if any of the aforementioned are not available after this time, the job will be deemed as cancelled and subject to a cancellation charge. Please see sections 5.8 to 5.10 for cancellation details.

5.3 A minimum of 5 working days notice is required prior to the install date; the ability to fulfill the requested date is dependant upon the availability of the engineer and parts.

5.4 The booking time advised has a window of 2 hours which is the arrival time for our engineer. Please allow additional time for the install to be completed.

5.5 We do not quote time for installations as each one is unique, but as a guide you can expect a standard hands free car kit install to take up to 1.5 hours.

5.6 In the event of poor weather conditions, our technician will require a covered area to work under. This is to protect the upholstery and electrics of your vehicle and the components we are installing or repairing from rain water damage. This area should be spacious enough to allow both front doors of the vehicle to be fully opened without obstruction.

5.7 Our technician’s are not insured to work in National Car Parks (NCP) and it is not our responsibility to pay for any other type of metered parking. For Health and Safety reasons and for the protection of your vehicle, work cannot be carried out on busy main roads and dual carriageways. Please contact Nationwide Vehicle Contracts if you are unsure of these conditions or need to make alternative arrangements.

5.8 Please be advised that a cancellation fee of £60 + VAT will be charged if access to the vehicle is not possible for reasons beyond our control, less than 24 hours notice is received by Nationwide Vehicle Contracts to change the appointment date and/or time, cover is not available in poor weather conditions, or any of the relevant points above has not been adhered to.

5.9 We reserve the right to cancel an installation up to 8 hours prior to the agreed time. This will only happen where the circumstances are out of our control and can not be rectified in time of the install.

5.10 Please note our hours of business are 9.00 – 17.30 Monday to Friday, excluding bank holidays, please note that cancellations must be communicated during business hours.

5.11 An important part of the process is that our technician checks your vehicle’s electrics and discusses the specifics of the work to be carried out prior to its commencement. Once completed, a signature will be required to agree the work has been carried out to your satisfaction and the vehicle has been left in the same condition. If you are not available, could you please nominate someone to act on your behalf as failure to do so many invalidate the warranty and any further claims.

5.12 If the work to be carried out relates to a hands free car kit, then your mobile phone must be made available at the start of the job. This ensures that the car kit supplied is the correct one for the handset and allows our technician to perform a thorough performance and functionality test. Without the handset we cannot guarantee the kit will be fully operational when you come to use it and cannot be held responsible for a subsequent call out.

6. Equipment

6.1 The term ‘Damage Free Bracket’ relates to the mounting of a mobile phone holder to the dashboard of a vehicle. It does not mean a completely damage free installation. When a separate loudspeaker is fitted to a vehicle, small drill holes are made to secure the bracket to a panel, usually out of sight, in the passenger footwell. Every effort is made to make the holes as inconspicuous as possible, but if you are concerned about this, please contact the Supplier.

6.2 ‘Audio Muting Leads’ cannot be fitted to vehicles with amplified stereo systems. This is because the audio does not operate through ALL of the speakers; it causes echo, interference and feedback. In these circumstances, the external loudspeaker supplied with the hands free car kit will be fitted. If you are unsure as to whether your system is amplified, please refer to the owner’s handbook.

6.3 If an audio mute lead has been ordered, we will require the radio code for the stereo (this is normally a 4 digit number), please ensure this is given to the engineer upon his arrival. Without this number, we will be unable to fit the lead and the additional visit to fit the mute lead at a later date will be charged at an additional service call charge of £60.00.

7. Risk/Title

7.1 The goods are at your risk from the time of delivery.

7.2 Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of:

  • 7.2.1 the goods, and
  • 7.2.2 all other sums which are or which become due to the Supplier from you on any account.

7.3 The Supplier shall be entitled to recover payment for the goods even though ownership of any of the goods has not passed from the Supplier.

8. Your right of cancellation

8.1 To exercise your right of cancellation, you must give written notice to the Supplier by hand, post or e-mail, giving details of the goods ordered and (where appropriate) their delivery. Notification by phone is not sufficient.

8.2 For 'Fully Tailored Specific Fit' car mats sets, it must be understood that this product is, and will be, manufactured to you exacting requirement and will, therefore, be unique to you and your vehicle/model. In this instance, we cannot accept any returns of these, particular, mat sets, unless subject to 8.3.

8.3 Except in the case of faulty or misdescribed goods, if you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the Supplier at your own cost. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. In the case of faulty or misdescribed goods we shall, after receiving notification in accordance with clause 10.3 or 10.4, either collect the goods from you or ask you to return the goods yourself and possibly refund you the reasonable postage costs.

8.4 Once you have notified the Supplier that you are cancelling the contract, the Supplier will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.

8.5 Except in the case of faulty or misdescribed goods, if you do not return the goods as required, the Supplier may charge you a sum not exceeding the direct costs of recovering the goods.

9. Warranty

9.1 All goods supplied by the Supplier are warranted free from manufacture defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.

9.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the Suppliers instructions, or any alteration or repair carried out without the Suppliers approval.

9.3 If the goods supplied to you are damaged on delivery, you should notify the Supplier in writing within 14 days.

9.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify the Supplier in writing as soon as possible, but in any event within 14 days of the date you discovered or ought to have discovered the damage, defect or complaint.

9.5 For products that have received a professional install, in the event your vehicle exhibits operational faults and it is taken to a garage for investigation, Nationwide Vehicle Contracts must be contacted prior to any work being carried out and have the opportunity to rectify any reported fault. If the Supplier isn’t allowed or given the opportunity, Nationwide Vehicle Contracts cannot accept any liability for work carried out by another party. After pre post checks are completed – if the airbag light comes on, Nationwide Vehicle Contracts must be notified within 3 working days and a return visit must be arranged via Nationwide Vehicle Contracts. Failure to do this will exempt Nationwide Vehicle Contracts from any responsibly.

9.6 At the time of install should any of the information about the vehicle differ from that on the order confirmation and consequently prevents the install to be completed, this may result in additional service call costs.

10. Limitation of Liability

10.1 Subject to 10.2 below, if you are a consumer the Supplier shall not be liable to you for any loss or damage in circumstances where:

  • 10.1.1 there is no breach of a legal duty owed to you by the Supplier or by its employees or agents;
  • 10.1.2 such loss or damage is not a reasonably foreseeable result of any such breach;
  • 10.1.3 any increase in loss or damage resulting from breach by you of any term of this contract.

10.2 Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Suppliers negligence or fraudulent misrepresentation.

10.3 If you are a business customer the Supplier shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

11. Data Protection

The Supplier will take all reasonable precautions to keep the details of your order and payment secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you.

12. Images

Product images are for illustrative purposes only and may differ from the actual product.

These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract, save that consumers resident in Scotland shall have the right to insist upon these terms being construed in accordance with the laws of Scotland and to submit to the jurisdiction of Scottish courts.
